Terms & Conditions

Please read these Terms and Conditions carefully prior to hiring services of Live Fabulous – Redefining Interiors. Acceptance of your order will be on the understanding that you have read, fully understood, and agreed to the proposal submitted and these Terms and Conditions. Our quotation for services is prepared based on agreement between client and Live Fabulous and is valid for fifteen days from the date of issue. Upon hiring us, the services will be rendered as per the payment terms. If there are any aspects that are unclear to you, they should be raised prior to acceptance. Although every effort is made by us to ensure recommended components are suitable. It is, however, client’s responsibility to check that all details of order are in accordance with requirements.

• Our Work Timings

Working Hours – Morning 10am to 7pm.                                                       Working Days – Monday to Saturday.

• Scope of Work
• Live Fabulous agrees to provide design services as outlined in the project proposal shared separately.
• If client wishes to add to the scope of work – which impacts timelines and cost, needs to be approved before commencement of work.
• The scope of work may include details as mentioned below –
  1. Interior Design Consultation Services Only:
• Our goal is to develop a cohesive, functional design plan that can be implemented in a timeframe, cost efficient, and style consistent with our clients’ desires.
• Client will supply all necessary information in written and give all necessary approvals/decisions for the proper and complete design. If instructions are not forthcoming, Live Fabulous cannot be held responsible for delays.
• Live Fabulous would be responsible for timely finalisation of Concept board. In case of any legit reason for delay, it will be our responsibility to keep the client always informed.
• Electrician, handyman, help for installation, cleaning personnel etc. as required will be arranged by the client as required during the installation. Else additional labour charges will be applicable.
• Accessories, furnishing, décor items are integral part of the designing and client will allocate necessary funds to source with the Interior Designer.
• Third-Party Purchases/Vendor Services Engaged:
• Live Fabulous may provide recommendations of the third-party purchases/vendors. You are open to scrutinize, evaluate & negotiate the terms with third-party vendors as suitable. And only upon full satisfaction may choose to make purchases/hire the vendor. Live Fabulous will not be responsible in any way for the competence and performance of their services.
• Live Fabulous will only be involved in the design process and review the work to ensure the work is being done in accordance with the layout, themes, specifications & design plans shared at the beginning of the project. No changes to be done without keeping Live Fabulous in loop.
• During the Site visit, if we observe any sub-quality material is being used or any work is being done poorly, we shall inform our clients so the it can be addressed directly with the contractor.
• Any repairs, returns, and changes in services raised by the client will be mutual responsibility between Client and third-party vendor. 
• It is the responsibility of the Client to check custom order quotes and/or order confirmations for accuracy. Live Fabulous does not take responsibility for any orders placed by the Client or upon Clients’ approval and does not track the orders.
• The Client is responsible for follow-up, arranging all deliveries, accepting all deliveries and associated costs. Live Fabulous is not responsible for delays or cancellations by vendors and does not provide the installation or assembly of third-party purchases.
• All Payments to third party vendors will be done directly by the Client. Live Fabulous has no tie ups with any shops or vendors, hence will not be involved in financial transactions between Client and Vendors.
• As your designer, to be able to deliver the home of your Dreams, we expect the following from you!! –
  • Trust the trained eye of your designer.
  • Have Realistic Expectations.
  • Approximate amount you want invest in your home
  • Quick decision making.
  • Be ready for Surprises!!

1. Turnkey Services –

• All benefits included of (2a) as mentioned above.
• During construction or manufacturing process, our job is to be your advocate, protecting you and your valuable time by managing the work, checking on orders, answering detail questions, maintaining timelines, troubleshooting, coordinating with contractors, subcontractors, and karigars.
• The Client is responsible for accepting delivery, shipping costs and taxes as on actuals.
• Special custom-made items cannot be cancelled once approved design’s manufacturing has commenced. Payment for all such items is required in full. Standard items might be subject to a cancellation charge from the manufacturer/supplier if cancelled.
• All images shown on our professional page, website, and company literature are for guidance only and exact shades of wood, fabrics and other natural products cannot be guaranteed. For example, wood is a natural product and therefore slight movement and variation in colour and grain can occur. Samples should be regarded as approximate representation only.
• All fabrics are susceptible to fading if exposed to strong artificial lights or direct natural light for prolonged periods. We are unable to accept liability for fading. We would also draw your attention to the fact that where fabrics are subject to variations in atmospheric conditions, shrinkage and/or dropping may occur in situation for which, we cannot be held responsible.
• Times and dates quoted for delivery of goods or materials, or completion of any work are to be treated as an approximate estimate based on current conditions and the Live Fabulous shall not be held responsible for delays outside its control. Although Live Fabulous will endeavour to keep to this time frame, if goods are delayed for any reason, we cannot accept liability for consequential losses as a result.
• In case of the change in price of any product and/or service due to non-availability, Live Fabulous will inform the client other alternatives with the reasons of change.
• Live Fabulous is responsible for last mile delivery. The cost of packaging is included in the cost; however, cartage, loading and unloading will be extra & on actuals.
• Each delivery of goods must be inspected by the customer or nominated representative to confirm receipt of goods. Any complaints in relation to goods having suffered accidental damage prior to delivery must be notified to Live Fabulous within 30 days and not beyond that.

• Payment Details –
• Fees for services will be based on Proposal attached.
• A non-refundable deposit of 15% is required to commence work.
• Progress payments will be made according to the following schedule mentioned in the proposal. In case of any discrepancy in payment schedules, work will be put on hold until the payment schedule is followed.
• Final payment of 5% will be due at the time of project handover.
• We provide all technical drawings cad with specifications to clients upon clearing for full and final payment.
• All online payments will be with additional 18% tax as per the government laws

Bank Details for remittance –

• Client Responsibilities:
• Site Facility and obligation

Local approval for project execution (i.e. from Landlord, Neighbour, Municipality, Local Police, RWA, Local club etc. as applicable) paying for all necessary licenses, deposits and permissions for the work scope shall be the responsibility of the Client. Power, washroom, and drinking water shall be arranged by Client.

• Changes and Variations –

During the Design period, client can review the plans and ask up to two changes. Once concept is finalised and work is executed, no changes can be done. If still needed, can be done on additional cost as per below steps –

• Client will notify us in writing (over email) for changes that are required. We request that you refrain from communicating directly with the team/workers for any changes or details, as such communication will not be considered official or binding.
• We will notify client of the costings for any changes or variations. Only upon written approval, the work will be commenced. This may have impact of the timelines agreed.

• Delay in Completion of Project –

If the contract is delayed or extended from the defined date of delivery due to Clients’ unavailability, delayed approvals, unscheduled changes, inability to take decisions, failure to provide necessary information or any other personal reasons; may result in adjustments to the timeline and/or additional costs.

Client will have to make their full and final payments on designated dates. For the remaining design, we shall be available to work on at a personal level, but professionally no project can go on “indefinitely”.

          Live Fabulous will be responsible in delivering the Project as per the agreed timelines, for any reasons beyond control will be communicated in advance. Daily work update will be shared with client on the whatsapp group.

• Communication Protocols –
• All official communications and approvals must be documented in writing, over email/whatsapp.
• For daily updates and quick communication, we will create a Whatsapp group once the work commences, let us know if any other mode is preferred.
• Regular update meetings will be scheduled to discuss project progress and any issues that arise.
• Attempting to incentivize a team member to work directly or engaging Live Fabulous vendors outside of the agreed-upon terms is strictly prohibited and will result in immediate contract termination.

• Intellectual Property:
• All design concepts, drawings, and materials provided are the intellectual property of the Live Fabulous.
• The client may not reproduce, distribute, or use these materials for other projects without the written consent of the Live Fabulous.

• Confidentiality and Right to Use for Publicity & Marketing purpose –
• A Mandatory “before” and “after” set of pictures are the right of Live Fabulous to click and display on social media, its professional website and further use the same for publicity across various forums.
• Live Fabulous is free to engage a professional photoshoot once the project is completed.
• To ensure the privacy of our client is not compromised, Live Fabulous will take outmost care and will not share the address or any content that could disclose the Client’s personal information.
• You can view our work on our professional website or Social Media page. Owing to safety & security of our clients, we refrain taking prospective Clients on the sites that have been completed.

• Force Majeure

Live Fabulous shall not be liable for any failure of performance due to force majeure, an act of God, accident, fire, earthquake, curfew, strike, epidemic, or any other event beyond its control. In this situation Client agrees to pay Live Fabulous for all services that have been requested and/or completed up to this stage.

• Termination Clause:
• Either party may terminate this contract by providing 15days written notice.
• In the event of termination, the client agrees to pay Live Fabulous for all work completed up to the termination date.

• Warranties and Guarantees:
• Live Fabulous provides a warranty for workmanship and materials used in the project for a period of 2 Years.
• Live Fabulous will extend all the guarantees of the branded hardware, accessories by logging in complaints with the respective service center and comply with company’s norms for benefit the client.
• Warranty does not cover damage caused by misuse, negligence, force majeure, or unauthorized alterations.

• Dispute Resolution:
• Any disputes arising from this contract will be resolved through mediation or arbitration before resorting to litigation in courts of Delhi.
• The prevailing party in any legal action will be entitled to recover reasonable attorney’s fees and costs.

• Subjective Nature of Interior Design:

By signing this contract, both parties agree to the terms and conditions outlined above.
